民行关系初探

[关键词]契约精神;权利;民法;行政法
[摘要]民主参与、合作、协商的契约精神是民法与行政法关系的契合点。这种契约精神在行政立法、行政执
法和行政司法各个环节均有所体现。而且,契约精神在行政领域得以运用具有积极作用,一方面,契约精神在
行政法领域的运用,为行政法从“执法型”行政向“引导型”行政发展起到促进作用,也为行政活动提供新的管
理思路。另一方面,民法中的契约精神在行政法领域被认可肯定,也为民法发展提供公法环境,进一步确认了
公民的权利地位与权利意识。民法与行政法具有相互促进、互利共赢的关系。

A bstract: The converging point of the re la tion sh ip be tween civil law and adm inistrative law is the covenant sp irit of democ ra tic
participation, coop e ra tion and con su lta tion. Such covenant sp irit is em bod ied in all spheres of adm inistrative legislation, law - enforce2
ment and adm in istra tion of ju stice. Mo reove r, the covenant sp irit has p layed a positive ro le in fie ld of adm in istra tion. On one hand, the
app lication of covenant sp irit in the fie ld of adm in istra tion p romo te s adm inistrative law deve lopm en t from‘executive adm in istra tion’to
‘gu id ing adm in istra tion’and a lso p rovides a new adm inistrative ideas for adm inistrative ac tion.
