On Legal Thoughts of Homosexual Marriage

摘要
伴随人类社会的不断进步以及***者人权运动的兴起与发展,一些国家和地区的民众对***者的态度越来越宽容,这促进了同性婚姻合法化的不断发展。国外的同性婚姻立法形式根据对***者婚姻家庭权利的保护方式的不同分为零星的规则模式、家庭伙伴(同居者)立法模式、登记伙伴(注册伴侣)立法模式、同性婚姻立法模式。我国也出现了许多关于***及同性婚姻的法律权利及保护的观点,但同性婚姻合法化会带来很多弊端以及在我国以立法形式确认同性婚姻尚与国情不符,同性婚姻立法条件尚不成熟。鉴于此,理论上保持对话,立法上科学、谨慎,应当是当代中国对待同性婚姻问题的基本立场和姿态。

Abstract
With the progress and development of human society and the rise of gay rights movement, people in some countries and regions, more tolerant attitude toward homosexuals, which promotes the legalization of same-sex marriage evolving. Same-sex marriage legislation in the form of foreign ways, depending on the protection of the rights of gay marriage and family is divided into sporadic rule model, domestic partner (cohabitants) legislative model, registered partners (registered partnership) model legislation, same-sex marriage legislation mode. There have been a lot of ideas about legal rights and protection of homosexuality and same-sex marriage, but legalize same-sex marriage will bring many disadvantages as well as same-sex marriage is recognized in our country and the situation is still not pay through legislation, same-sex marriage legislation conditions are not ripe . In view of this, in theory, keep the dialogue on legislative science, caution should be the treatment of same-sex marriage in contemporary China's basic position and attitude.
