.64 .工作实践知识产权2015年第2期电子商务领域知识产权保障机制研究刘斌陶丽琴洪积庆内容提要:电子商务的发展对知识产权保障机制提出了时代需求。从电子商务平台商的角度出发,强化电子商务领域知识产权保障机制,在内容上应当包涵知识产权监管机制和知识产权维权机制。在电子商务知识产权保障机制中,平台商在电子商务平台网络交易中是独立的第三人,基于一定的规则与协议而享有一定的监管权力。但这种管理权在目前电子商务领域知识产权保障机制中并未完全发挥其作用,在监管机制与维权机制中均表现出一定的现实缺陷。针对这些缺陷,需要对电子商务知识产权的监管机制与维权机制进行相应的完善。关键词:电子商务知识产权保障机制监管机制维权机制Abstract: Modern requirements have been putting forward for guarantee mechanism of intellectualproperty during the development of merce. From the perspective service provider merce platform, it is necessary to strengthen guarantee mechanism for intellectual property, andinclude supervision mechanism for intellectual property and protection right mechanism for intellectual propertyin content. In guarantee mechanism for intellectual property, net service provider is a neutral third party merce platform, and enjoy certain regulatory powers for certain rules and agreements. But theregulatory power has been not fully played its role in guarantee mechanism for intellectual property in the fieldof merce, and shown a real defect in supervision mechanism and protection right mechanism.
