从“深喉”事件看美国匿名消息来源

摘要
使用匿名消息在美国早已成为一种比较普遍的现象,但对于匿名消息来源的处
理仍没有比较确定的结论。由匿名消息来源而引发的记者入狱、假新闻等事件时有
发生。新闻记者是否使用、如何使用匿名消息,如何处理与匿名消息来源的关系,
一直是美国新闻界面临的道德和法律上的难题。
对于匿名消息来源引发的种种冲突,我们不能简单地做媒介表象层面的分析,
而应通过更深层次的挖掘来探询其根源。本文以“深喉”事件为例,并结合美国历
史上有关该命题的几个重大事件,从美国的民主制度、法律精神以及媒介运作等方
面对匿名消息来源及其造成的困惑做深层次分析。
本文首先分析了《华盛顿邮报》对“深喉”的运用和保护,指出“深喉”事件
为美国新闻界揭发政治丑闻树立了典范。此后,保护匿名消息来源以取得重要证据
的模式,成为记者进行调查性新闻报道的重要手段。
通过对美国民主制度的阐释,分析了匿名消息来源出现的根源以及媒体运用匿
名消息来源的动因,指出正是这种民主制度下的宪政体制导致了媒体和匿名消息提
供者在同一事件中的两套不同的行为规范。
法律精神为司法独立和新闻自由提供了保障,但是由此而引发的公正审判与隐
匿权问题却造成匿名消息案件在不同社会大环境中的不同审判结果。
为匿名消息提供者保密已成为美国新闻界一项重要的职业道德准则,但是媒体
滥用匿名消息来源却给媒体自身的正常运转带来极大的伤害。
本文试图从民主、法律、媒介这三个方面分析美国社会对匿名消息来源使用和
保护的原因以及匿名消息来源造成的困惑和解决之道,以期对我国新闻界正确运用
和保护匿名消息来源提供借鉴。

Abstract
It’s popular to use anonymous information in America. But there has no exact
conclusion for how to deal with the anonymous information sources. Because of it
journalists often be put into prison and false reports be pressed frequently. As journalists,
if they can use the Anonymous information, how to use it, and how to deal with the
relation between journalists and the anonymous information sources, which have been
problems in meral and law for journalism in America to face.
As the variety conflicts for anonymous information sources, we can’t analyse them
in presentational lay in medium simply, but dig them across deep hiberarchy to detect their
rootstock. The paper base the case of “Deep Throat”, bine some important affair
relate the proposition, to analyse the anonymous information sources and the wilder from
America democratic system, law pneuma and medium operational and so on.
The paper analyse the use and protection of Washington Post about the “Deep
Throat”, and point out that the “Deep Throat” built up a mirror for journalism in America
to disclose politic scandals.
