摘要

随着互联网技术飞速发展,各种互联网设备记录了人类社会复杂频繁的信息
行为从而产生了惊人的数据量,人类社会的产生的信息总量呈现出几何级数的增
长,数据被认为是:“未来的石油”,人类社会进入大数据时代这一高阶信息社
会形式。
大数据时代背景下的人类社会各主体的生存与思维模式都受之影响而被深刻
改变,社会主体本身、社会主体之活动、社会主体之周边都得以通过“数据”演
绎、记录。大数据技术,尤其是大数据挖掘技术的迅速普及带来的社会商业模式、
政府行为模式的变迁带给当下个人信息保护以巨大挑战,加之我国正处于社会转
型期,而又未构建有专门的个人信息保护制度,因此,研讨适合国情、时代背景
的个人信息保护保护制度是十分必要的。
本课题首先分析了大数据技术背景下个人信息保护的困境,介绍了大数据挖
掘技术的特点与运用。其后,本文比较研究了欧、美、日本的相关法律制度,并
研讨了他国立法经验对我国制度够艰难的启示。最后,本文提出了构建大数据时
代个人信息保护制度的新思路,及具体制度建议。

ABSTRACT

With the rapid development of technology, a variety of devices
recorded plexity of human social behavior information frequently resulting in a
staggering amount of data, the amount of information generated by human society
showing growth in geometric progression, the data is considered to be: "future oil ",
human society entered the high-end of the information society in the form of big data
era.
Survival and thinking all the main human society under the background of big data
have been profound changes in the social body itself, the main activities of the
community, the munity have been through the body of the "data"
interpretation of the records by the impact. Big Data technologies, especially large data
mining technology has brought rapid spread of social business model, changes of
government behavior patterns in order to bring the present great challenges to protect
your personal information, combined with China is in a period of social transition, but
did not build a dedicated personal information protection system,
