摘要摘要有违法应当制裁。但纵观我国司法实务,刑讯逼供、超期羁押、侵犯被追诉方辩护权等现象时有发生,而立法针对我国行使刑事追诉权的专门机关及其工作人员的违法行为却没有建立完善的制裁制度。因此,如何有效遏制程序性违法行为、保障诉讼参与人的基本权利,已成为我国刑事司法实践中一个亟待解决的问题。文章通过对程序性违法行为及其制裁进行研究,对我国完善程序性违法行为的制裁机制做了一次尝试性的探讨。除引言和结论外,本文共分为四部分: 第一章从程序性违法行为的概念入手,阐明其特征,分析对程序性违法行为进行制裁的必要性,并就实体性制裁和程序性制裁进行比较。第二章考察域外程序性违法行为的相关制裁制度。文章分别考察了两***系国家的非法证据排除规则、终止诉讼制度、撤销原判制度、诉讼行为无效制度、解除羁押制度和从轻量刑制度,分析其借鉴价值。第三章分析我国有关程序性违法行为制裁的立法现状,并针对程序性制裁存在的缺陷进行阐述和原因分析。第四章分析制裁程序性违法行为应遵循的原则,并提出程序性违法行为制裁机制的构建思路。一方面对现有的实体性制裁可能进行改革的空间进行探讨,特别针对国家赔偿的细化以及单独民事赔偿之诉可行性的分析;另一方面,完善我国的程序性制裁制度构建,扩大程序性制裁的范围,增加程序性制裁的方式,及其配套制度完善。结论部分再次强调本文主要观点并对未来我国程序性违法行为的制裁加以展望。我国立法有必要建立和完善程序性制裁机制,使现有法律法规所确立的程序性制裁发挥效用,并与实体性制裁互相配合,以抑制程序性违法行为的发生。关键词:程序性违法行为实体性制裁程序性制裁 Abstract Abstract There isalways astorture,extend custody,infringement upon the right of defense,etc,have been surviving the prohibition timeandagain incriminalpractice,but Chinese criminalprocedural law doesn’testablishtheprocedure sanctionofthoseillegal actswhich breachthelegal litigationprocedure from thecriminalprocedure systemand , how torestrainprocedural breachesandproviderights e a greatproblem which needs tobe solved immediately.
