摘要

地理标志保护是国际国内工业产权保护中的热点问题之一,受到社会的普
遍重视。我国虽有相关法律法规,但在保护体制和具体实施等方面仍显不足,
因此在思考对地理标志的保护问题时,应当树立更加具有开放性和前瞻性的指
导思想,建立和完善有中国特色的地理标志的法律保护体系。
本文将从法学和经济学的角度依据当前世界经济一体化的形势,运用国
际公约协定及国内规定中关于商标及地理标志法律保护的相关理论主要采用
实证分析的方法、比较分析的方法、理论联系实际的方法以及案例分析的方法
对我国地理标志法律保护进行解析。
文章通过强调我国在加入后,在多边贸易体制下参与国际贸易竞争时
进行地理标志保护的必要性和重要性对国内外地理标志法律保护进行历史
回顾,对比了国内外保护地理标志的立法模式之后结合我国实际情况提出我
国地理标志保护过程中存在的现实问题,并建议从保护多方利益出发,探寻我
国地理标志工作在相应制度及法律保护体系等方面的完善措施和未来发展趋
势。

本文的主要观点和研究内容如下:
一、我国作为农业经济大国拥有众多名优产品,加强地理标志保护是增强
我国产品尤其是农产品国际竞争力的必要选择。
二、通过研究我国地理标志保护现状,提出地理标志保护工作中的问题主

要表现在我国特有的“双重保护”模式的矛盾冲突。

三、对于今后我国地理标志保护工作,建议可由统一部门注册管理地理标
志。另外可考虑借鉴国外立法经验,在《原产地域产品保护规定》和《地理标
志产品保护规定》基础上进行专门立法。

Abstract
The Geographical Indication Protection, which is one of the hot
issues in domestic and international protection of intellectual property
rights, is universally concerned by the society. Despite some correlated
laws and regulations in our country, there still appear deficiencies in the
protecting system and actual implementation. Thereby we should build a
more open and foreseeing guiding thought, establish and consummate a
law system of Geographical Indication Protection with Chinese
characteristics when e to consider the issue of Geographical
Indication Protection.
This thesis mainly gives us an analysis to the Geographical
Indication Protection of China from the angle of law and economics
based on the current economic globalization, using the theories in
international treaties and domestic rules about brand and Geographical
Indication Legal Protection. It chiefly uses both demonstration analysis
