随着现代科技的日益发展,涉及高科技及需运用科技手段解决的行
政纠纷日益增加。而传统上,法官作为法律专业人员,并不拥有专业技
术知识,这就给法官裁判涉及高新技术知识的案件带来了重重的困难。
专家证人在涉及高新技术知识的案件中发挥着独特作用,专家证人通过
提供“意见”或“结论”性质的证言,扩大法官的感知能力,帮助法院查明
有关事项的因果关系,进行事实认定,从而有效解决诉讼过程中的技术
争议难题。随着我国诉讼模式从职权主义向当事人主义的转变,我们应
顺应行政诉讼改革和发展的趋势,积极引进专家证人制度,并探索专家
证人制度适应我国行政诉讼模式的方式,从而使专家证人制度应有的作
用得以发挥。

Abstract
With the development of modern science and and more
administrative cases involving high technology,a growing numbers of
administrative cases need to use technology to solve. Traditionally,the judge
is just the legal professionals,they do not have technical expertise. Judge met
with great difficulties when they judge these , the expert
witness in these cases played a unique role: expert witness by providing
“opinion” or “conclusion” nature of the testimony, Help the judge's ability to
raise awareness, and understand the reasons for the case, ascertain the facts,
and thus referee the dispute in the the pattern of Administrative
proceedings change from Authority principle to the parties,we should follow
the administrative proceedings the trend of reform and development, and
actively introduce expert witness system, and explore expert witness system
to adapt our way of administrative litigation mode. Let an expert witness
system work better is our goal。
