摘要不动产预告登记制度是民法中关于不动产物权变动的重要制度,它以风险防范为价值取向,旨在保护期待不动产物权变动的权利人基于其不动产物权取得的债权请求权的利益。大陆法系国家如德国、瑞士、日本和我国台湾地区都有该制度的设置。我制度,翻开了不动产登记制度新的一页。预告登记是与本登记相对应的一项制度,是指为保全一项以将来发生的不动产物权的设定、转移、变更或者消灭为目的的请求权而进行的提前登记。经预告登记后的请求权, 其性质为具有一定物权效力的债权,是债权物权化现象的表现形式之一。预告登记制度作为登记制度的一种特殊类型,不是独立存在的,而是与一国的物权变动制度紧密相连。不同的物权变动模式直接决定了各适用范围的不同。本文通过考察各具有权利保全效力、顺位保全效力、破产保护效力以及预警效力,并对相对无效的效力规范模式以及公权力的介入、租赁权物权化对权利保全效力的限制作了阐述。完整的预告登记制度还包括预告登记的变动,主要从预告登记的发生、转让、推进及消灭进行研究。本文总结以往理论研究成果,参照各的适用范围、效力以及变动方面的完善意见。我制度的真正有效发挥作用,需要在将来的不动产登记法律、法规中对预告登记制度做出详尽的和可操作的规定。关键词:预告登记适用范围效力变动 Abstract Thepreliminary registration ofthereal estate is allimportant civilinstitutioneonceming thc transference ofthe realproperty riskprevention as itsvalue orientation,the purpose ofthepreliminaryregistration is toretainthecreditor’Sright toclaimwhen heexpects thetransference ofthe realproperty right based on the of the Civil Law countries such asGermany,Japan, Switzerland andTaiwan have adopted thelikeinstitution.
