摘要
夫妻的财产不仅是婚姻家庭生活得以正常运转的物质保障,而且还影响着第三人的利益
和民事交易安全,关系到市场经济的稳定运行。因此,夫妻财产制在婚姻家庭法上的重要性
是不言而喻的。我国自新中国成立以来共颁布了两部《婚姻法》、一部修正案及两部司法解
释,《婚姻法》司法解释(三)征求意见稿也于 2010 年出台,都对夫妻财产制做出了重要的
规定,在不同的历史时期发挥了重要作用。我国现行《婚姻法》是 2001 年修订的,但是随
着市场经济的迅速发展,人们的物质、文化生活水平不断提高,夫妻财产的数量和种类日益
增多,夫妻与第三人的经济交往日趋频繁,夫妻的个人财产观念也有所增强,该法已经不能
适应新情况,解决新问题,需要进一步修改和完善。本文运用历史分析和比较研究的方法,
从夫妻财产制的基本理论出发,分析了自新中国成立以来,我国《婚姻法》对夫妻财产制的
立法规定,进而分析制度所体现的价值取向及其成因,对中国与国外相关立法进行简单的比
较分析,根据现代夫妻财产制的发展趋势,针对我国现行《婚姻法》中夫妻财产制立法的不
足,从立法体例、通则性规定、非常夫妻财产制、夫妻财产登记制度及具体内容方面,提出
进一步的完善建议,为《中国民法典·婚姻家庭编》中夫妻财产关系法的修改和完善提供有
益建议。

Abstract
Property of the spouses is not only a marriage and family life to the normal operation of
material security, but also affects the interests of third persons and civil transaction safety, related
to the stable operation of the market economy. Therefore, the importance of property system of
husband and wife in marriage and family law are self-evident. In China since the founding of new
China has issued two amendments to the Marriage Act, a part of the Department and the
Department of Justice explained that the judicial interpretation of the law on marriage (iii) draft
