摘要量刑建议是检察机关在刑事诉讼活动中,就被告人应当适用的具体刑罚包括刑种、刑期、执行方式向法院提出意见的诉讼活动。量刑建议权则是检察机关所享有的作出量刑建议行为的权力。它既是一项犯罪追诉权,又是一项司法请求权, 同时还是一项程序性权力,并且是一项专属性质的法定职权,本身不具有终结性和处罚性,是检察机关代表国家行使法律监督权的方式之一。量刑建议制度即是指检察机关行使量刑建议权的相关制度。英美法系和大陆法系许多国家在量刑建议制度的实践方面取得了许多值得我国借鉴的经验。从应然的层面看,量刑建议制度是从程序上保证量刑公正的良策,是节约司法资源提高诉讼效率的基石,是提高公诉人素质的有效机制,是强化控辩双方诉讼职能的契机。但我国刑事诉讼法未明确规定该制度,由此而带来诸多弊端。具体表现在:量刑不公开,法院自由裁量权过大;庭审形式不能充分体现控辩职能;不利于保护被告人的合法权益; 检察机关不能充分行使抗诉职能;当庭宣判率过低,不利于提高诉讼效率:对量刑秘密操作的不满,导致诉讼成本增加。因此,提出我国确立量刑建议制度的如下构想:①量刑建议制度的基本原则为基准刑上下浮动原则、分步提出原则、理由充分原则和行使法律监督职权原则。②量刑建议的种类可分类:弹性量刑建议; 相对确定性量刑建议与确定性量刑建议。③量刑建议的基本内容包括适用范围、适用主体、提出时间、量刑答辩、量刑建议案件的抗诉以及建立相关的配套制度等方面。关键词:量刑建议;量刑建议权;量刑建议制度;公正;效率竺至型至些璧::圣 Abstract The suggestion ofdiscretion ofpunishment is alitigation activity inwhich the procuratorial authority suggests the court what punishment includes thekind ofpunishment,the term ofimprisonment and themode right of it means the procuratorial authority’s power tosuggest the discretion ofpunishment.
