“二元结构”视野下的行政调解制度研究

中文摘要

官方文件的推崇、学界研究的蓬勃与实践运作的萎靡构成了当下行政调解制度
的现实生态。行政调解自身内部机制设计不合理及外部衔接不通畅是造成其现状
萎靡的两大主因。法定范围模糊、机构设置偏颇、程序设计缺失、法律效力尴尬
等内部机制问题及与人民调解、行政复议、行政诉讼等制度的外部衔接问题制约
着行政调解制度的发展。在多元化纠纷解决机制重塑的过程中,行政调解具有相
应的生存空间。“民事纠纷”和“行政争议”分立的“二元结构”是解决当下行政
调解问题的全新思路,也是行政调解制度未来发展的方向。按“二元结构”的思
路对行政调解的主体、程序和效力进行制度设计,并处理好与其他民事纠纷和行
政争议解决机制的衔接,有望最大程度发挥行政调解在化解社会矛盾中的作用,
进而为社会稳定与和谐做出特殊的贡献。

A study on the Administrative Mediation
from the “dualistic structure”

Abstract

The mendation of the official law documents, the flouring study in the law
circle and the depression of the practical operation constitute the status quo of the
Administrative Mediation in China. The irrational system design and the non-fluent
connection with other dispute solution mechanisms are two main reasons led to the
practical depression of the Administrative Mediation. The problems of system design
such as confusing scope, the biased subjects, the lacking procedure and the awkward
effectiveness, combined with the problems of connection with the People's Mediation,
the Administrative Reconsideration and the Administrative Proceedings, have restricted
the development of the Administrative Mediation. In the process of remolding the
multi-dispute resolution systems, the Administrative Mediation has the living space. The
“dualistic structure” which distinguishes the “administrative dispute” from the “civil
dispute” is not only a new approach to resolve the problems the Administrative
Mediation, but also a new direction of future development. If the subjects, the procedure
and the effectiveness of the Administrative Mediation are designed according to the
“dualistic structure”,
