摘要
财政自治权是宪法和民族区域自治法赋予民族自治地方的一项至关重要的
自治权,是实现民族区域自治制度的物质基础。财政自治对落实民族区域自治至
关重要,直接关系民族自治地方其他自治权的落实状况,也是保证民族自治地方
稳定与繁荣发展的物质保障。真正实现民族自治地方的财政自治是保证民族自治
地方经济社会能够顺利发展的重要途径,符合民族自治地方的整体利益,也是当
前解决民族问题的重点和关键。离开财政自治,民族自治地方的其他自治权就无
法落实,民族区域自治制度更无法正常运行。当前,民族自治地方的财政自治还
存在很多问题,比如,财政自治立法滞后、财政自治权的行使缺乏监督、财政支
出结构不合理、财政转移支付不规范,等等。研究民族自治地方财政自治法律制
度,既是我国民族地区经济和社会发展的需要,又是建设民族法制的需求,具有
重要的理论意义和现实意义。本文就是力图从民族自治地方财政自治权的基本理
论入手,对民族自治地方财政自治的现状进行分析,并力求通过落实民族自治地
方的财政自治权、加强民族自治地方财政收支法制建设、规范民族自治地方的财
政转移支付制度等途径来完善我国民族自治地方财政自治法律制度,促使民族自
治地方财政迅速强大,有效缓解民族自治地方居民生产生活上的困难。这对促进
民族自治地方的经济发展、维护民族团结,以及国家的繁荣发展和长治久安都具
有十分重要的意义。

Abstract
Abstract
Financial autonomy, the material base of realizing the system of ethnic regional
autonomy, is a crucial autonomy that the constitution and the law entrusts with the
Autonomy Minority Areas. It’s crucial to carry out ethnic regional autonomy,
financial autonomy directly relates to the implementation of the other autonomy of
Autonomy Minority Areas, but also the material guarantee of ensuring the stability,
prosperity and development of the Autonomy Minority Areas. Truly realizing the
financial autonomy of the Autonomy Minority Areas is the important way that
ensure the Autonomy Minority Areas’ economic and society can develop smoothly,
which tallies with the overall interests of the Autonomy Minority Areas, is also the
key to current nationality question. Without financial autonomy, other autonomy of
the Autonomy Minority Areas can’t carry out, the system of ethnic regional autonomy
can not wok normally as well. Presently, financial autonomy of the Autonomy
Minority Areas still has many problems, such as the financial autonomous legislation
is backward, the exercise of financial autonomy lack supervision, the financial
expenditure structure is unreasonable, financial transfer e
