摘要
保险利益是起源于英美法上的一个概念英文的术语是 Insurable Interest (可
保利益) 英美法系中对保险利益的研究由来已久目前已经形成了较为成熟的
保险利益理论
我国的现代保险行业发展较晚虽然保险法学界对保险利益也进行了一些研
究但是研究的重点却一直放在财产保险利益上对于人身保险利益问题的研究
长期以来存在很多争议近期保险法修改之际许多学者提出应废止人身保险利
益对人身保险合同当事人的约束而以大陆法系国家采用的同意原则取而代之
在本文中笔者通过对保险利益原则和同意原则的分析对比结合我国保险
市场以及人文环境提出了我国人身保险必须要坚持人身保险利益原则适用性和
严格实行同意原则和保险利益原则双重约束的观点以期进一步完善我国保险立
法和执法环境给我国人身保险市场发展提供必要的法律支持

Abstract
Insurable Interest is a terminology originating mon Law. It has been
studied for long time and presently formed mature theories mon Law.
In our country, modern insurance develops relatively late. Insurance theory field
has involved some Insurable Interest, however, emphasizing on Insurable Interest of
Property Insurance. There are still a lot of issues on Insurable Interest study of Life
Insurance so far. In the near future Insurance Law will be amended, so, recently many
scholars suggest the restraints imposed by Insurable Interest on the contractors in Life
Insurance contract be forbidden and the rules involved be replaced by Consent of
Insured Rule adopted by Civil Law.
In this article, through making an analysis parison on Insurable Interest
Rule and Consent of Insured Rule, against our insurance market and objective
surroundings, the writer argues that in our country the Life Insurance institutions
should accord to the double rules, say, Consent of Insured Rule and Insurable Interest
Rule. By these, the writer wishes to improve our legislation and execution in
insurance field and to provide our life insurance market with necessary law support.
