论文摘要：在我国社会主义初级阶段, 由于劳动力的市场供给相对剩余以及社会保障制度尚不太健全等原因，劳动者在劳动关系中往往处于不利的弱势地位，其合法权益在现实中经常受到侵害，并得不到及时有效的保护。《劳动法》和《劳动合同法》相继颁布之后，劳动者的权益有了有力的法律保障，但在司法实践中仍有诸多问题存在，本文主要从劳动者的弱势地位及《劳动法》和《劳动合同法》三个方面对劳动者权益保护进行探讨与研究。
