论农村宅基地使用权制度

　　内容提要: 农村宅基地使用权是我国特有的一项独立的用益物权,是农村居民在依法取得的集体经济组织所有的宅基地上建造房屋及其附属设施,并对宅基地进行占有、使用和有限制处分的权利。它具有严格的身份性、无偿使用性、永久使用性、从属性及范围的严格限制性等特点。其取得方式有原始取得与继受取得,消灭形式有绝对消灭与相对消灭。农村宅基地使用权人享有权利并负担义务。我国农村宅基地使用权制度存在许多缺陷,亟待完善。
　　2005 年6 月26 日召开的十届全国人大常委会16 次会议第三次审议通过的物权法草案(以下简称“三审稿”) 设专章规定了宅基地使用权。但由于我国目前在城市还没有宅基地使用权制度,国有土地上只有建设用地使用权,所以“三审稿”以及后来的“四审稿”中的“宅基地使用权”实际上就是指农村宅基地使用权。到目前,众所瞩目的物权法还没有出台,但草案中关于“宅基地使用权”部分的规定应该不会有多大变化。农村宅基地使用权所涵盖的内容很多,单靠寥寥无几的几个法条是无法全面概括的。况且,我国的农村宅基地使用权制度极其不完善,存在许多漏洞,有必要对其进行研究。
