    一、著作权的概念、性质和内容
        （一）著作权的概念：
         亦称。指文学、艺术、科学作品的作者创作作品而依法享有的人身权和财产权的总称。
          广义概念包含著作权与邻接权。著作权、专利权、商标权构成知识产权的主要内容。
        （二）著作权的法律性质
         TRIPS协议认定知识产权是私权。著作权属于民事权利。
        著作权与物权、债权等一般民事权利相比，又有特殊性：著作权客体具有无形性、可复制性等。
        著作权与物权、专利权、商标权的区别
       （三）著作权的内容
        指著作权具有的具体权利。有两类具体权利：著作人身权（又称精神权利）和著作财产权（又称经济权益）。
        著作人身权:发表权、署名权、修改权、保护作品完整权四项权利。
        著作财产权：复制权、发行权、出租权、展览权、表演权、放映权、广播权、信息网络传播权、摄制权、改编权、翻译权、汇编权12项。被视为著作权内容的权利还有：注释权、整理权、编辑权、追续权等。
        应由著作权人享有的其他权利。
