摘要量刑建议权是检察机关在公诉改革活动中提出的一个新课题,它的试行引起了社会的广泛关注。自试行以来,理论界对量刑建议权的性质、量刑建议权存在的必要性以及如何构建量刑建议权运作机制等问题存在诸多争议,司法实务界对量刑建议权的态度也莫衷一是。量刑建议权是指公诉人在出庭支持公诉过程中,根据被告人的犯罪事实、犯罪情节、性质和社会危害程度代表人民检察院建议人民法院对被告人处以某一特定的刑罚、刑期、罚金以及是否应缓期执行等方面提出具体意见的权力。本文在综合各方观点的基础上,拟对量刑建议制度系统阐述。量刑建议的内容为法官量刑提供了参考,有助于促进量刑的实体公正;量刑建议限制了法官的自由裁量权,使量刑程序更加精密,有助于量刑的程序公正。我国设立量刑建议制度是非常必要的。在构建我国量刑建议制度时应遵循相应的原则,处理好各个具体的问题,并要注意和其它程序制度的协调。关键词:量刑建议公诉权刑罚权诉讼原则英文摘要 The power of sentencing suggestion is a new research issue of procuratorial authority’S prosecution reform,its enforcement captures wide-ranging regards of the its trial to today。there has been extensive disputes on the nature,the essentiality and the pattern of the sentencing suggestion system inthe field of theory。it isalso differential on the attitude to it in the judicial practice.
