摘要
在“制度热”的热度下降的背景下,对制度的局限性展开研究的学者专家日益增多,
其成果也颇为丰富。但是成果是分散的、零星的,缺乏深入的哲学析理,系统整体的分
析框架以及结合丰富实践的经验印证,更无人以“制度效用有限论”为题作系统研究。
本文认为,围绕“制度效用有限”展开的理论分析框架是制度变迁理论的组成部分。
笔者旨在从哲学的视角来解析制度效用有限的哲学意蕴;从静态的视角来析理制度的供
需错位、制度的僵化滞后、制度的效用失灵和制度的文本异化;从动态的视角来解析运
思时它会受到时地的约束,制订时它会受到认识的局限,实行时它会受到利益的纠缠,
并重点解析利益集团。最后,用新农村建设的实践经验来印证制度效用的有限。
本文试图通过对制度的供需错位、制度的僵化滞后、制度的效用失灵和制度的文本
异化之间的内在联系进行尝试性探讨,并力图通过对利益集团的深入剖析来说明:制度
是重要的,但其效用是有限的,从而为强调制度的实践功用和制度的不断创新提供理论
支撑。

ABSTRACT
Under the background of the dropping of "the institution heat ", the scholars and the
experts which launch the research to the institution limitation increase day by day, at the same
time their achievements are also rich. But the achievements are dispersible and fragmentary,
lack the depth for philosophical analysis, the analysis frame of whole system and the
experiences verification with rich practice, and ever nobody take "the limited theory of
institution utility " as a topic to study systematically.
This article thought the theoretical analysis frame base on which " the limitation of
institution utility " is the part of the institution vicissitude theory. This article aims at
analyzing the philosophy implication of the limited theory of institution utility by philosophy
analyzing; Analyzes the principle institution from the static angle of view the supply and
demand dislocation, the ossified lag, institution utility malfunctions with the institution text
dissimilation; The driven condition angle of view analyzes exercises the mind when it to be
able to receive when the place restraint, when the making it can receive the understanding
limitation, when the implementation it can receive the benefit to pester, and analysed special
interest group with emphasis. Finally, verifies the institution utility with the new rural
reconstruction experience limited.
