消费者权益保护法论文:
《消费者权益保护法》完善之我见
摘要: 我国已颁布实施了16年的《消费者权益保护法》,对保护消费者权益无疑发挥了巨大作用。但随着经济和社会的发展,新型消费关系、消费形式不断涌现,消费者权益受到侵害的情况日益严重,特别是近几年食品、药品行业接连发生的群体伤害案件,逐渐暴露出我国消费者权益保护法律制度上存在的不足与缺陷,消费者权益难以得到充分而有效的保护。因此,对消费者权益保护法律制度的完善需要进一步探讨和研究。
Abstract: China has promulgated and implemented "protection of consumers' rights and interests" for 16 years to protect consumers' rights and interests,which undoubtedly played a big role. But along with the economic and social development, new consumer relationship, consumption form, consumers' rights and interests are infringed upon seriously, especially in recent years, food, pharmaceutical industry occurred group damage cases in ession,gradually exposing the ings of the legal system of the protection of consumers' rights and interests, thus the consumers' rights and interests could not get a full and effective protection. Therefore, the perfection of legal system of the protection of consumers' rights and interests needs further discussion and study.

消费者权益是指消费者在购买、使用或接受服务时享有的为法律上所确认和保护的权利和利益,包括人身权益和财产权益。为保护消费者的合法权益,我国自20世纪90年代以来,我国陆续颁布了一系列保护消费者权益的法律、法规,形成了由《消费者权益保护法》(以下简称《消法》)、《产品质量法》、《食品安全法》、《反不正当竞争法》、《农产品质量安全法》等法律、法规以及相关司法解释组成的消费者权益保护法律体系,为保护消费者权益,打击侵害消费者权益的违法行为等方面无疑发挥了巨大作用,确立了“以人为本”立法指导思想。为适应形势的发展,作为行政主管部门的国家工商行政管理总局办公厅2009年10月15日发布《关于征求<消费者权益保护法>(修订稿征求意
