摘要:旅游合同是稳定旅行社与游客之间的交易行为,对双方当事人产生约束和保护作用,督促双方履行各自的合同义务,实现各自的合同目的一种重要手段。近年来,我国旅游业迅猛发展,在实际中发生的旅游合同纠纷越来越多。为了保护旅游者合法权益,维护旅游市场的正常秩序,保障和促进旅游经济的健康发展,亟需立法。本文将从旅游合同基础理论,旅游合同纠纷和旅游合同立法三个方面研究入手,整理并归纳学术界已有的研究成果。最后,在此基础上提出自己对我国旅游合同研究的看法。

Abstract: Tourism contract is stable between travel agents and tourist trade, the parties have a binding and protection, urge the parties to fulfill their contractual obligations to achieve their purpose of the contract an important recent years,tourist contract e into being more and more ,with the rapid development of our country’s protect the legal right of tourist and promoting the health of the tourism economy development and keep the order of the tourism market,it need to establish paper did an overall review on tourism contract studies in China by focusing on three aspects,some radical theory,tourist contract entanglements, and legislation of the the end, On the bases of this studies,the author put forward some views about tourism contract in China.
