司法责任制度研究.pdf

内容摘要
如何构建符合中国特色的司法责任制度,是我国在新世纪的社会转型过程中,解
决存在的司法官在司法过程中出现的司法不公,司法腐败等问题,发挥司法在解决社
会矛盾,促进社会和谐的现实出路。近年来,我国在司法责任方面进行了很多努力,
并取得了一定成果,但并没有完全建立起权责明确具体的司法官责任。
本论文从比较法学的视角,通过阐述我国历史上的司法责任制度建立实施的状况,
从中找出建立我国司法责任制度的历史文化因素及借鉴经验,并通过对西方法治先进
国家的司法责任制度的比较,探索出一些经验并结合我国目前的做法,分析评价了各
自的优缺点,最后提出构建我国司法责任制度的思路和完善的相应制度。
本论文分为两大部分,第一部分是理论建构部分,也即论文的第一章,在已有的
研究的基础上,阐述我国历史上的司法责任制度和西方法治先进国家的司法责任制度,
,包括第二、
三、四章。在第二章进行了有关构建司法责任制度的必要性分析,第三章是有关司法
责任制度的内容分析,。第四章是有关构建司法责任制度的一系列配套制度的分析,这
些配套制度主要有司法官选任制度、任职保障制度、培训制度、经费保障制度以及地
区回避制度等,从不同的侧面共同构成司法责任制度有效运行的保障。

Abstract
How to build the Chinese characteristics of the judicial duty system in the new
century,lt is the process of transformation of society to address the existence of judges in
the judicial process of a miscarriage of justice、judicial corruption,the judiciary play in
resolving social conflicts,promoting social harmony way out of recent years,
our country duty in the administration of justice carried out a lot of efforts and achieved
some results,but did not fully establish a clear and specific powers and responsibilities of
the judicial duty.
This thesis from the perspective parative law,through the history of our
country on the duty of the judicial system set up to implement the conditions,set up to find
my country in the history of judicial responsibility and learn from the experience of cultural
factors and the rule of law through the Western developed countries duty of the judicial
pared the experience to explore some of our country bination with the
current practice,and analysis and evaluation of their strengths and weaknesses,finally put
forward to build our country the idea of judicial accountability system and improve the
corresponding system.
