贪污罪及受贿罪法定刑问题分析研究.pdf

摘要***、受贿等***现象是当今困扰世界各国的一大社会问题。***、受贿犯罪为人民群众所深恶痛绝。随着我国反***工作的进一步深入,如何发挥刑罚的惩治和预防功能,对***、受贿犯罪正确适用刑罚,是立法机关和司法机关需要高度重视的问题。当前,我国***罪受贿罪法定刑设置存在很多问题,在一定程度上影响了打击和预防***受贿犯罪的成效。为着力解决这一闯题,本文首先研究了法定刑设置的基本原理,包括法定刑的概念、法定刑的设置原则和法定刑的设置方式。本文认为法定刑是指刑法分则对各种犯罪所规定的应处刑罚的标准,包括适用刑罚的种类和量刑幅度,是人民法院量刑的准绳。文章在提出明确性原则、均衡性原则、正义性原则是法定刑的配置原则之后,对法定刑的三种设置方式即绝对确定的法定刑、绝对不确定的法定刑、相对确定的法定刑作了介绍,并进一步考察了我国***罪、受贿罪法定刑的历史沿革,揭示了我国***受贿犯罪法定刑规定的特点,在此基础上广泛参考了其他国家和我国港澳台地区关于***罪受贿罪法定刑的规定,借鉴他们的立法经验,从法定刑设置的基本原理出发,剖析了我国刑法典中***罪受贿罪法定刑设置存在的主要问题,如资格刑规定的缺位、生命刑规定的浪费、财产刑规定之不足、入罪数额标准不科学、刑罚幅度的外部不协调、刑度内部不协调、受贿罪的量刑比照***罪处理很不科学;最后提出了自己的完善建议;增设罚金刑,调整没收财产刑、完善资格刑的内容,对***罪受贿罪增设资格刑、取消分则条文中规定的免刑条件和非刑罚的处理方式、在适当时候从立法上废除***罪受贿罪的死刑、对***罪受贿罪应分别规定不同的法定刑、修改有关数额的规定,将目前的以数额为主修改为以情节为主确定法定刑,同时提出了法条修改的建议稿。关键词:***罪;受贿罪;法定刑;立法缺陷;立法完善 Corruption and bribery are big socialproblems which persecute everycountry all OVa"the they ale extraordinary hated by with the anti—corruption work inChina,The le:gislature andjudicial authority must attachgreat importance tohow to exert thepunishing andpreventing function ofpenalty,and the proper appficafion ofthepenalty tocorruption and bribery.
