摘要
污点证人作证豁免制度在许多国家得到确立和发展,特别是在一些英美法系国家该
制度比较成熟,在各国的刑事诉讼领域发挥了巨大的作用。该制度在国际社会也得到了
认可,在《公民权利和政治权利国际公约》、《联合国打击跨国有组织犯罪公约》、《联合
国反腐败公约》等国际条约中也有关于该制度的规定。这项制度也成为一个国家法治进
步程度的体现之一,遗憾的是我国还没有确立这项刑事诉讼法律制度,但是他已经成为
我国学者研究的热点问题。如果能够成功移植这项法律制度,将会解决我国刑事诉讼中
存在的一些问题,推进我国刑事诉讼法律制度的进步。
本文首先对污点证人进行了界定,详细阐述了污点证人作证豁免制度,比如制度的
性质、特征、类型。然后考察了英、美、德三国对该制度的规定,分析了该制度在这些
国家的运行状况,以备借鉴之用。污点证人作证豁免制度体现了法律的公平、效率、秩
序价值,并且在司法实践中我国对于该制度也有需求,该制度的确立有利于我国的法治
进步。本文在充分考量我国司法环境的基础上,借鉴了一些国家的先进做法,提出了在
我国构建污点证人作证豁免制度的一些设想,包括全面系统的规定该制度的适用条件,
适用范围,适用对象,豁免类型,适用程序,并规定相关的配套制度,从而保障该制度
在我国能取得丰硕的成果。

Abstract
Abstract
Immunity of witness for tainted witness has been established in many countries,
particularly in mon law countries,immunity of witness is relatively mature. It
played a significant role in the field of criminal proceedings. The system has also been
recognized in the munity. The system was contained in the “Civil and
Political Rights, the International Covenant”, “United Nations Convention against
anized Crime”, “United Nations Convention against Corruption” and other
international treaties. The system has also e a mark of Progress in the rule of law.
Unfortunately, China still not established the system in the criminal legal system, but it has
e a hot issue for chinese scholars. If we can transplant the legal system essfully, we
will solve some problems in criminal proceedings, and promote the progress of chinese
criminal legal system.
This paper first defines the tainted witnesses, illustrate immunity system of tainted
witnesses, such as the nature, characteristics, types. Then parative research methods,
examines the system in the British, the United States, Germany ,and analyze the system
operational status of these countries to prepare for reference purposes. Immunity system of
