信托业的国际比较及其对我国信托业发展的启示.pdf

摘要我国的信托制度自 1979 年恢复以来,信托业经历了数次的清理整顿,但仍未找到比较现实的出路,而在信托理念方面又存在颇多的混淆与争议,这就给我国信托业的发展蒙上了一层阴影。虽然已经有数十家经整顿后重新登记的“信托投资公司”踏上了新的征途,但我国信托业何去何从还是存在着很大的变数。本文试图从社会、经济、历史等诸多角度对美国、英国、日本等国家的信托业进行比较研究,希望可以从中探索些信托业发展过程中存在的规律性的东西, 以期为我国发展中的信托业提供些参考与借鉴。本文结合了上述诸国的具体国情对各国信托业的产生与发展进行了较为详细的比较分析;对各国的信托法律制度、信托监管体系、信托机构治理模式及信托业务也进行了系统的比较研究;还依据国际金融业的发展趋势,研究了国际信托业的发展状况及未来的发展趋势。本文在深入研究了我国信托业产生与发展及历史与现状的基础上,对我国信托业的深层次问题进行了剖析;并针对我国信托业发展过程中存在的问题,指出了完善社会信用环境,完善信托法律体系是信托业发展的前提;提出了我国信托业现阶段应确立以法人信托为主,其他形式信托为辅的发展模式。本文同时阐述了信托业不是“信托投资公司”的集合,也不是“信托投资公司”所经营业务的集合的独特的观点;还依据国际信托业的发展趋势,结合我国的具体国情,提出了不同形式的信托业务可以由不同类型的金融机构兼营的思路。关键词: 信托;比较研究;启示 ABSTRACT The Trust industry in this country has experienced the reconsolidations and anizations for several times since the restoration of the Trust System since 1976. But the reality of the Trust business’ goal is st ill under uncertainty and unclearly. This main course still under the clouds and can not get the conclusions for the reality solutions. The existing confusions and arguments in the theory and ideal aspects which shadows the developments of the Trust industry in this country. Although, there are more than dozens of “Trust Inve panies” have engaged the new guiding lines for the business after the merged and registrations. The brightness future for the Trust industry is still under the quest ion marks and filled wi th the variable on the initiation stage. This article attempts to analyze p are the Trust industry in USA, England and Japan from the society, economic and hist orical point of view. It expects that may search after the regularity and typical patens in the developing stag es in this industry from pre-existing the Trust industry in other countries. It will be very helpful to gain the experience and take as the references for our developing th e Trust industry from other countries. This bines the detailed analysis parison based on the emergence, development, foundations and background for each nation unique conditions.
