Classified Index: CODE: 10075 .: NO: 20100280 A Dissertation for the Degree of The supplementary investigation research system Candidate: LiuYan Supervisor: Prof. Feng Jun Prof. FanShouLu Specialty : Juris Master Academic Degree Applied for : Juris Master (Law ) University : Hebei University Date of oral examination : June , 2012 摘要 I 摘 要 退回补充侦查在刑事诉讼法中体现了程序价值,尊重和保障了人权,是我国刑事诉讼中的一项独特制度。退回补充侦查是原侦查工作的一种延续和必要补充,具有弥补原侦查工作的缺陷和纠正错误的法律监督性。在现阶段的司法实践中,退回补充侦查类型中最为常见的是审查起诉阶段的补充侦查,其具有明显的由检察机关退回到侦查机关的流程。而在法庭审理阶段和审查批准逮捕阶段中出现的退回补充侦查的情形,虽无明显机关之间的流转,但亦不能否认其退回补充侦查的实质。在法治改革的推进下,我国的退回补充侦查制度自身运行中暴露出的问题日益显现。检察机关在立法上的权力不断扩大,而对犯罪嫌疑人在退回补充侦查程序中的权益却逐步缩减,以及在实际操作中出现了假借退回补充侦查之名,延长办案时间,超期羁押犯罪嫌疑人的情形,加上案件被退回补充侦查的比例升高,侦查机关对退补的案件不积极办理,检察机关为规避公诉失败的不利后果而选择退补的现象等等。这些问题使退回补充侦查在现实生活中呈现失控的状态,与当初国家的立法意图相违背。本文通过对退回补充侦查现状的分析,清楚的看到了它在实际运作中的缺陷和不足,规范退回补充侦查制度至关重要,使这一制度在完善的框架内得到良性循环。具体而言,从宏观上要制定科学统一的法律规范,真正做到有法可依;从微观上要对退回补充侦查机制的合理构建提出相应的具体措施和配套的保障措施。最终转变传统的司法理念,严格规范制度本身,使其应有的诉讼价值得到充分发挥。关键词 退回补充侦查 现状及检讨 侦检关系规范化 Abstract II Abstract The supplemental investigation which embodies the procedure value, respect and protect human rights is a unique system in our country criminal proce dures.
