[相关法规]
　　《消费者权益保护法》第7条规定，消费者在购买、使用商品和接受服务时享有人身、财产安全不受损害的权利。消费者有权要求经营者提供的商品和服务，符合保障人身、财产安全的要求。该法第41条规定，经营者提供商品或者服务，造成消费者或者其他受害人人身伤害的，应当支付医疗费、治疗期间的护理费、因误工减少的收入等费用，造成残疾的，还应当支付残疾者生活自助具费、生活补助费、残疾赔偿金以及由其扶养的人所必需的生活费等费用;构成犯罪的，依法追究刑事责任。
　　《消费者权益保护法》对上述赔偿项目的金额如何确定没有作出规定，2001年1月1日起施行的《浙江省实施〈中华人民共和国消费者权益保护法〉办法》第54条作了具体的规定，弥补了法律空缺。其中规定：医疗费，按照医院对受害者治疗所必需的治疗费、检查费、医药费、手术费、住院费等费用计算;残疾赔偿金，根据受害者伤残等级，按照当地年平均生活费的六倍至十五倍计算;并规定的伤残等级按交通事故伤残等级标准确定;当地年平均生活费，是指受害人居住地市、县统计部门公布的上年度城镇居民人均年消费水平或者农民人均年消费水平。
