Abstract
The crime of fraud classified as one kind of crime of enroachment upon property is the prevelent crime all the time in the criminal judhicial field. As the production of the development of our socialist market economy, the crime of contract fraud get out of the crime of fraud and be convicted independently. But the contract fraud is after all a type of fraud crime, so there exists many similarities between the crimes of fraud and contract fraud coupled with the diversity, complexity and imperceptibility of the means of contract fraud. So the boundary between the crimes of contract fraud and fraud has e a big problem. The author thinks that the boundary of the contract fraud and fraud bears important practical significance for this kind of case. Throughout this paper, it analyzes the controversial focus of a practical case bination with the research results of the theory circle in order to analyze and research the boundary problem of contract fraud and fraud.
The first part of the thesis statement of the case facts, and find five focus of dispute.
