苏州大学硕士学位论文行政诉讼中的体系解释姓名:赵华阳申请学位级别:硕士专业:法律硕士(法学) 指导教师:上官丕亮 201105 行政诉讼中的体系解释中义摘要行政诉讼中的体系解释中文摘要由于行政法律规范在形式上没有统一法典、规范性文件数量庞大、复杂繁乱、位阶不等、层次不清,在内容上规范对象宽广、内容易于变动,行政法规范体系中有大量不确定的法律概念和条款,以及法律之间、法条之间的关系非常复杂,这些使得法官们在行政诉讼的实践中对法律的含义及其适用拿捏不准、左右为难,甚至出现法律适用错误的问题。为破解这些问题,需要寻求体系解释这一工具。体系解释能够通过协调同一法律上下条文之间以及不同法律条文之间的复杂关系,明确相关涵义,消解条文与条文、法律与法律之间的矛盾和冲突,促进同一法律内部和不同法律之间的和谐与统一。在我国的行政诉讼实践中,虽然体系解释开始得到运用并取得了一定的成绩,但是仍然存在尚未受到普通重视等诸多问题,其主要原因是我国现行法律没有赋予法官个案法律解释权。针对目前出现的问题,应该首先在立法上明确法官的个案法律解释权,在行政诉讼实践中优化法官的法律解释环境,同时加强法官对体系解释具体操作和解释技巧的训练。关键词:行政诉讼法律解释体系解释法官个案法律解释作者:赵华阳指导教师:上官丕亮 Abstraet Systematic Interpretation Administrative Litigation Systematic Interpretation inAdministrative Litigation Abstract Intheform ofadministrative law,there is nounifom alarge number of normative plicated legalnorms,ranging rank and content,there arebroad noiTn objects,and the content iseasy thesystem of Administrative Law,there are alarge number ofuncertain legal concepts andterms,the relationships between differentprovisions and between differentlaws arealways judges oftenget intodilemma when theyunderstandandapply thelawinthe practice ofAdministrative Litigation,even apply should use systematic interpretation coordinating therelationship between theupper and lowerprovisions withinthesame lawandtherelationshipbetween different provisions indifferent laws,systematic interpretation clear relevant sense,reduce contradictions and conflictsbetween differentprovisions and between differentlaws, promote harmony andunity within thesame law and between the practice ofAdministrative Litigation,judgesbegan to use systematic interpretation and made some achievements,but there are stillmany problems,forexample lackofattention. mainly because thelegislationexisting did not provide thejudge theright oflegal theseproblems,legislation should firstprovide udges theright of interpretation,and improve theinterpretati
