1 论农村私房买卖合同的效力【摘要】近年来农村私房买卖市场活跃,关于房屋买卖的纠纷也是越来越频繁。是否允许宅基地上的房屋买卖,我国法律规定不甚明确, 国务院有关文件则指出城镇居民不得购买农村住宅以及取得宅基地使用权,而《合同法》对合同效力的认定又另有规定,相关规定的不相一致,使农村私房买卖合同的效力,成为历来争论的热点之一。本文从农村私房买卖行为中涉及的不同的法律关系入手,综合分析我国现行立法下有关农村私房买卖行为的法律规范,来探讨农村私房买卖合同效力的问题。【关键词】农村私房买卖合同效力宅基地使用权 Abstract Rural Private trading markets in recent years, the active disputes on buying and selling homes is ing more and more frequent.
