人民检察院检察建议工作规定

(二)应当消除的隐患及违法现象;
(三)治理防范的具体意见;
(四)提出建议所依据的事实和法律、法规及有关规定;
(五)被建议单位书面回复落实情况的期限等其他建议事项。

第五条　人民检察院在检察工作中发现有以下情形之一的，可以提出检察建议:
(一)预防违法犯罪等方面管理不完善、制度不健全、不落实，存在犯罪隐患的;
(二)行业主管部门或者主管机关需要加强或改良本行业或者部门的管理监督工作的;
(三)民间纠纷问题突出，矛盾可能激化导致恶性案件或者群体性事件，需要加强调解疏导工作的;
(四)在办理案件过程中发现应对有关人员或行为予以表彰或者给予处分、行政处分的;
(五)人民法院、公安机关、刑罚执行机关和劳动教养机关在执法过程中存在苗头性、倾向性的不标准问题，需要改良的;
(六)其他需要提出检察建议的。
第六条　人民检察院可以直接向本院所办理案件的发案单位提出检察建议。
需要向发案单位的上级单位或者有关主管机关提出检察建议的，办理案件的人民检察院应当层报被建议单位的同级人民检察院决定并提出检察建议。
第七条　提出检察建议，应当按照统一的格式和内容制作检察建议书，报请检察长审批或者提请检察委员会讨论决定后，以人民检察院的名义送达有关单位。
